Terms and Conditions

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that all registration information you provide is accurate and current.

AirquerAI provides short-term-rental market research tools, including:

• Market Analysis - aggregated market-level performance data for a chosen location;
• Competitor Lens - performance data and metrics for a specific listing;
• Revenue Calculator - estimated revenue, occupancy, and ADR projections for a property based on comparable listings.

Requests you submit are queued and processed asynchronously; results are typically delivered to your dashboard within a short time, but processing time is not guaranteed. Reports may include data sourced from our third-party market data provider and, for certain features, an AI-generated plain-language summary.

2.1 Not professional advice

All outputs - including revenue estimates, market comparisons, and AI-generated summaries - are provided for informational purposes only. They are not investment, financial, tax, or legal advice, and should not be relied on as the sole basis for any investment or business decision. You are solely responsible for independently verifying any information before acting on it.

2.2 Third-party and AI-generated content

Market and listing data is sourced from third-party providers and reflects information available at the time of the request; it may be incomplete, delayed, or inaccurate, and we do not guarantee its accuracy. AI-generated summaries are produced by third-party language models and may contain errors, omissions, or "hallucinated" statements. You should treat all AI-generated content as a starting point, not a verified fact.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@airquerai.com if you suspect unauthorized use of your account.

4.1 Subscription plans

Certain features require an active paid subscription (monthly or annual), billed in advance through our payment processor, Stripe. Subscriptions renew automatically at the then-current price unless canceled before the renewal date. You can manage or cancel your subscription at any time through the billing portal in your dashboard.

4.2 Credits

Some features consume credits from your account balance, deducted at the rate shown in-app for that feature. Credits may be included with a subscription, purchased as one-off credit packs, or awarded as promotional bonuses. We check your credit balance before running any paid third-party lookup; if you have insufficient credits, the request is blocked before any third-party API call is made and no credits are deducted. Credits are deducted only once a request completes successfully; if a request fails after retries, no credits are charged.

4.3 Fees, changes, and refunds

All fees are stated in the currency shown at checkout and are exclusive of applicable taxes unless stated otherwise. We may change subscription pricing on renewal with advance notice. Except where required by applicable law (including statutory withdrawal rights for EU/UK consumers on digital services, which may apply until you begin using a purchased feature), fees and purchased credits are non-refundable, including unused credits at the time of cancellation.

4.4 Failed payments

If a payment fails, we may suspend paid features until payment is resolved, and may downgrade your account to the free tier after a reasonable grace period.

You agree not to:

• Use the Service to scrape, bulk-extract, or systematically reproduce our data or our market data provider's underlying data outside the ordinary use of the dashboard;
• Reverse engineer, decompile, or attempt to extract the source code of the Service;
• Circumvent credit limits, rate limits, or access controls;
• Resell, sublicense, or provide the Service or its outputs to third parties as a competing data product without our written consent;
• Use the Service for any unlawful purpose, or to violate the rights of any host, guest, or third party;
• Interfere with or disrupt the integrity or performance of the Service, or attempt unauthorized access to our systems or other users' accounts;
• Use automated means (bots, scripts) to access the Service except through any API we may formally publish and that you are authorized to use.

We may suspend or terminate accounts that violate this section, with or without notice.

6.1 Our IP

The Service, including its software, design, branding, and compiled/aggregated data presentations, is owned by AirquerAI or our licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business or personal purposes.

6.2 Underlying market data

Underlying short-term-rental listing data is licensed from a third-party market data provider and remains subject to their rights. Your use of exported or downloaded data is limited to your own internal analysis unless we agree otherwise in writing.

6.3 Your content

You retain ownership of any information you submit (e.g., a property address you're evaluating). You grant us a license to use that input solely to process your request and operate the Service.

The Service relies on third-party providers, including Supabase (infrastructure), Stripe (payments), a third-party market data provider, OpenAI (AI summaries), and Resend (transactional email). We are not responsible for outages, errors, or changes made by these third parties, though we will make reasonable efforts to maintain Service reliability.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MARKET DATA OR AI-GENERATED SUMMARIES WILL BE ACCURATE OR COMPLETE. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRQUERAI AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY REPORT OR ESTIMATE IT PRODUCES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. This limitation does not apply where prohibited by law, and nothing in these Terms limits liability for death, personal injury, or fraud where such limitation is unlawful.

You agree to indemnify and hold AirquerAI harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third party's rights.

You may stop using the Service and close your account at any time. We may suspend or terminate your account for violation of these Terms, non-payment, or as needed to comply with law. Sections that by their nature should survive termination (including Sections 6, 8, 9, 10, and 12) will survive.

12.1 Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, except where mandatory local consumer-protection law requires otherwise.

12.2 Informal resolution first

Before filing a claim, you agree to contact us at support@airquerai.com and attempt to resolve the dispute informally for at least 30 days.

12.3 Arbitration (where enforceable)

If informal resolution fails, disputes will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. YOU AND AIRQUERAI EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or, for non-consumer/business users, its Commercial Arbitration Rules), seated in Sheridan County, Wyoming, unless you and AirquerAI agree otherwise. You may opt out of this arbitration clause by emailing support@airquerai.com within 30 days of first accepting these Terms.

12.4 Consumer carve-out

If you are a consumer resident in the EEA, UK, or another jurisdiction where mandatory consumer-protection law does not permit pre-dispute arbitration or a class-action waiver, this Section 12 applies only to the extent permitted by that law, and you retain the right to bring proceedings in the courts of your place of residence and to rely on the mandatory protections of that law.

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AirquerAI regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
